1. Introduction
Welcome to Forevermore Moments and the Forevermore Momentos Shop.
These Terms and Conditions govern your use of our website, our services, and purchases made through our online shop.
Forevermore Moments provides services relating to the planning, coordination, styling, and creation of memorable occasions. Forevermore Momentos offers products that may include gifts, keepsakes, personalised items, accessories, and other special-occasion products.
By accessing our website, submitting an enquiry, booking a service, or placing an order, you agree to these Terms and Conditions.
Please read these terms carefully before using our website or purchasing our products and services.
Nothing in these Terms and Conditions is intended to limit any consumer rights that cannot legally be excluded under applicable South African law.
2. Our Services and Products
Forevermore Moments and Forevermore Momentos may offer the following:
- Event planning, coordination, and styling services.
- Wedding and special-occasion services.
- Gifts, keepsakes, and personalised products.
- Custom-made items and other products displayed in our online shop.
- Additional products and services as advertised on our website.
The specific services, product details, inclusions, prices, and delivery arrangements will be communicated through the relevant product listings, quotations, order confirmations, or written agreements.
We reserve the right to update our offerings where reasonably necessary. Any changes affecting a confirmed booking or accepted order will be handled in accordance with the applicable agreement and consumer protection laws.
3. Website Use
By using our website, you agree to do so lawfully and responsibly.
You must not:
- Use the website for fraudulent, unlawful, or misleading purposes.
- Attempt to gain unauthorised access to our systems.
- Upload malicious software or harmful content.
- Interfere with the security or operation of the website.
- Copy, reproduce, or misuse our content in violation of intellectual property rights.
We aim to keep our website accurate, secure, and accessible. However, we do not guarantee uninterrupted access or that all information will always be free from errors.
4. Enquiries, Bookings and Orders
4.1 Service enquiries and bookings
All enquiries for Forevermore Moments services are subject to availability.
A service booking is considered confirmed only once the required information has been received, the applicable quotation or service agreement has been accepted, any required deposit has been paid, and written confirmation has been provided.
Submitting an enquiry or receiving a quotation does not guarantee availability or secure a booking.
4.2 Shop orders
All Forevermore Momentos shop orders are subject to product availability and acceptance.
Customers must provide accurate contact details, delivery information, and any information required to personalise an order.
An automated order acknowledgement does not necessarily constitute final acceptance of an order.
We reserve the right to decline or cancel an order where reasonably necessary, including where a product is unavailable, a genuine pricing error has occurred, payment cannot be verified, or fraud is reasonably suspected.
If payment has already been received for an order that we cancel, any refund due will be processed in accordance with applicable law.
5. Pricing and Payments
All prices will be communicated in the applicable quotation, service agreement, product listing, or checkout process.
Unless otherwise indicated, prices are stated in South African rand (ZAR).
5.1 Event services
- A deposit or booking fee may be required to secure an event date.
- The remaining balance must be paid by the agreed deadline.
- Additional services, upgrades, changes, or requests outside the original agreement may incur additional charges.
- Applicable travel fees, delivery costs, venue expenses, taxes, or third-party charges will be disclosed where relevant.
A quotation is valid for the period stated in that quotation. Prices may change after the validity period or before a booking is confirmed.
5.2 Shop purchases
- Payment must be completed using the payment methods made available at checkout or otherwise approved by us.
- Orders may not be processed until payment has been confirmed.
- Delivery charges and other applicable fees will be displayed or communicated before an order is finalised.
- Genuine pricing errors will be addressed fairly, with the customer informed of the available options and any refund due handled in accordance with applicable law.
We reserve the right to pause or withhold services where agreed payments are overdue, subject to the applicable agreement and the law.
6. Event Service Responsibilities
6.1 Client responsibilities
Clients agree to:
- Provide accurate and complete event information.
- Make payments by the agreed deadlines.
- Communicate changes and special requirements promptly.
- Obtain permissions, permits, and venue approvals that fall within their responsibility.
- Ensure the venue is accessible and suitable for the agreed services.
- Treat our staff, representatives, and suppliers respectfully.
Clients may be responsible for reasonable additional costs arising from late changes, inaccurate information, or circumstances within their control, subject to the applicable agreement and law.
6.2 Changes to event bookings
Changes to the event date, venue, guest numbers, design, schedule, or selected services may affect pricing, availability, and delivery arrangements.
We will make reasonable efforts to accommodate requested changes but cannot guarantee that every change will be possible.
Any additional charges or changes to the original agreement will be communicated for approval before additional work is undertaken, except where urgent action is reasonably necessary and authorised under the agreement.
6.3 Third-party suppliers and venues
Some events may involve independent venues, caterers, photographers, entertainers, decorators, couriers, or other service providers.
Their own terms, availability, payment requirements, and cancellation policies may apply.
We will clarify our role and responsibilities in relation to third-party arrangements. We are not responsible for independent acts or omissions outside our reasonable control, but this does not exclude any responsibility imposed on us by law or by our agreement with the client.
7. Forevermore Momentos Shop: Products and Descriptions
We aim to ensure that product descriptions, photographs, prices, colours, sizes, and specifications are accurate.
Minor variations may occur because of lighting, screen settings, materials, manufacturing processes, or the handmade or personalised nature of certain products.
Product photographs are provided for illustrative purposes unless otherwise stated.
Customers should review product descriptions, dimensions, materials, and personalisation options carefully before placing an order.
8. Personalised and Custom-Made Products
Some products may be personalised or made to order using names, dates, messages, photographs, colours, or other specifications supplied by the customer.
Customers are responsible for checking the accuracy of the information they submit.
Where a design proof is provided for approval, customers should review it carefully before confirming production.
We are not responsible for errors arising from incorrect information supplied or approved by the customer, except where the error is attributable to us.
Personalised or custom-made products may be subject to different change-of-mind cancellation and return conditions where legally permitted. However, personalisation does not remove any applicable statutory rights relating to defective, damaged, or incorrectly supplied goods.
Customers confirm that they have the necessary rights or permissions for photographs, artwork, and other materials submitted for personalisation.
9. Cancellations, Postponements and Refunds
9.1 Event services
Clients wishing to cancel or postpone a booking must notify Forevermore Moments in writing as soon as possible.
Cancellation fees, where applicable, will be determined by the agreed booking terms and any reasonable costs already incurred.
Deposits, booking fees, and third-party expenses will be handled in accordance with the booking agreement and applicable law.
Postponements are subject to availability and may result in additional costs.
9.2 Shop orders
Customers who wish to cancel or amend an order should contact Forevermore Momentos as soon as possible.
Changes cannot be guaranteed once an order has entered production, been personalised, packed, or dispatched.
Cancellation and refund rights will depend on the circumstances, the stage of fulfilment, the applicable shop policy, and relevant consumer protection legislation.
9.3 General refund principles
Refunds, where due, will be processed within a reasonable period and in accordance with applicable law.
No provision in these terms removes any statutory cancellation, refund, or other consumer right that cannot legally be excluded.
10. Returns, Exchanges and Defective Products
We want our customers to be satisfied with their purchases.
Returns and exchanges will be handled in accordance with the applicable product policy and South African consumer protection legislation.
Customers should contact Forevermore Momentos promptly if they receive an item that is damaged, defective, incorrect, or incomplete.
To help us investigate, customers may be asked to provide their order number, a description of the problem, and photographs where appropriate.
Depending on the circumstances and applicable law, an appropriate remedy may include repair, replacement, or a refund.
Change-of-mind returns will be handled in accordance with any applicable statutory rights and any additional return policy we offer.
Personalised or custom-made items may be excluded from voluntary change-of-mind returns where permitted by law. This does not remove a customer’s statutory remedies for defective, damaged, or incorrectly supplied products.
Customers will not lose their legal rights merely because an issue was not reported immediately, although prompt notification can help us resolve matters efficiently.
11. Processing Times, Delivery and Shipping
Estimated processing and delivery times will be communicated on the relevant product page, at checkout, or in the order confirmation where applicable.
Processing times may vary depending on stock availability, personalisation requirements, order volumes, and supplier arrangements.
Delivery may be provided by Forevermore Momentos or an independent courier or delivery service.
Customers are responsible for providing a complete and accurate delivery address and contact number.
Delivery fees, available delivery methods, and delivery areas will be communicated before an order is finalised.
If an order cannot be delivered because the supplied information is incomplete or incorrect, additional charges may apply where permitted by law.
Delivery estimates are provided in good faith but may be affected by circumstances outside our reasonable control.
If a product becomes unavailable after an order has been placed, we will contact the customer to discuss available options, which may include waiting for restocking, selecting an alternative with the customer’s agreement, or receiving a refund where due.
We will not substitute a materially different product without the customer’s agreement.
12. Gift Orders and Recipient Information
Customers purchasing gifts are responsible for providing accurate recipient and delivery information.
Customers who require gift packaging or wish to avoid including pricing information should contact us before the order is dispatched.
Recipient information will be handled in accordance with our Privacy Policy and applicable data protection laws.
13. Photography, Content and Intellectual Property
All original website content, branding, logos, photographs, graphics, product designs, text, and other creative materials belonging to Forevermore Moments or Forevermore Momentos remain the property of the relevant owner or rights holder.
You may not reproduce, distribute, modify, or commercially use these materials without prior written permission, except where permitted by law.
Where photography or other creative materials are supplied as part of an event booking, the applicable agreement will specify the deliverables and usage rights.
We will obtain appropriate permission before using identifiable client or guest photographs, testimonials, or event content for marketing purposes where required by law.
Clients should communicate any privacy or photography restrictions before an event.
14. Privacy and Personal Information
We respect your privacy and are committed to handling personal information responsibly.
Personal information may be collected and used to:
- Respond to enquiries and prepare quotations.
- Manage bookings and customer relationships.
- Process payments and fulfil orders.
- Arrange deliveries and communicate order updates.
- Provide customer support.
- Meet legal and regulatory obligations.
Payments may be processed through third-party payment providers, whose own terms and privacy notices may also apply.
We handle personal information in accordance with our Privacy Policy and applicable South African data protection laws, including the Protection of Personal Information Act 4 of 2013 (POPIA), where applicable.
Customers should not send full payment card details or passwords through unsecured messages or email.
15. Third-Party Links and Services
Our website may contain links to third-party websites, payment platforms, courier services, or other external services for convenience.
We do not control these external websites and are not responsible for their content, security, privacy practices, or terms of use.
Accessing third-party websites is at your own discretion.
16. Limitation of Liability
Forevermore Moments and Forevermore Momentos will exercise reasonable care and skill in providing services and supplying products.
To the extent permitted by applicable law, we will not be liable for indirect or consequential losses arising from circumstances beyond our reasonable control.
We are not responsible for delays, interruptions, or failures caused by events outside our reasonable control, including severe weather, venue closures, supplier disruptions, courier delays, government restrictions, or other unforeseen circumstances.
Nothing in these Terms and Conditions excludes or limits liability for fraud, wilful misconduct, or any liability that cannot legally be excluded or limited.
Nothing in these terms removes consumer guarantees, remedies, or other protections that apply under South African law.
17. Force Majeure
Neither party will be considered in breach of its obligations to the extent that performance is prevented or materially delayed by circumstances beyond its reasonable control.
Such circumstances may include natural disasters, extreme weather, public emergencies, strikes, government restrictions, or major supplier disruptions.
The affected party must notify the other party as soon as reasonably possible. Both parties will make reasonable efforts to agree on an appropriate solution, which may include rescheduling, modifying services, arranging alternative delivery, or issuing a refund where required by the applicable agreement or law.
18. Customer Conduct and Fraud Prevention
Customers agree not to use our website, services, or shop for fraudulent transactions, unlawful activities, or any activity that interferes with the proper operation of our business.
We may investigate suspicious transactions and take reasonable steps to protect our customers and business, subject to applicable law.
19. Amendments to These Terms
We may update these Terms and Conditions from time to time to reflect changes in our products, services, business practices, or legal obligations.
The latest version will be published on our website with the applicable update date.
Changes will generally apply from the date they take effect. Existing confirmed bookings and accepted orders will remain subject to the terms applicable when the booking or order was made, unless the parties agree otherwise or applicable law requires a different result.
20. Governing Law and Consumer Rights
These Terms and Conditions are governed by the laws of the Republic of South Africa, where applicable.
Relevant legislation may include:
- The Consumer Protection Act 68 of 2008.
- The Electronic Communications and Transactions Act 25 of 2002.
- The Protection of Personal Information Act 4 of 2013.
The application of particular legislation depends on the circumstances and the nature of the transaction.
Nothing in these terms is intended to deprive a consumer of rights or protections afforded under applicable law.
